Apple is officially cutting support for progressive web apps for iPhone users in the European Union. While web apps have been broken for EU users in every iOS 17.4 beta so far, Apple has confirmed that this is a feature, not a bug. Commenting on Apple's move, Epic CEO Tim Sweeney tweeted: I suspect Apple's real reason for killing PWAs is the realization that competing web browsers could do a vastly better job of supporting PWAs -- unlike Safari's intentionally crippled web functionality -- and turn PWAs into legit, untaxed competitors to native apps.

Apple Confirms iOS 17.4 Removes Home Screen Web Apps In the EU (9to5mac.com) 136

Apple has now offered an explanation for why iOS 17.4 removes support for Home Screen web apps in the European Union. Spoiler: it's because of the Digital Markets Act that went into effect last August. 9to5Mac reports: Last week, iPhone users in the European Union noticed that they were no longer able to install and run web apps on their iPhone's Home Screen in iOS 17.4. Apple has added a number of features over the years to improve support for progressive web apps on iPhone. For example, iOS 16.4 allowed PWAs to deliver push notifications with icon badges. One change in iOS 17.4 is that the iPhone now supports alternative browser engines in the EU. This allows companies to build browsers that don't use Apple's WebKit engine for the first time. Apple says that this change, required by the Digital Markets Act, is why it has been forced to remove Home Screen web apps support in the European Union.

Apple explains that it would have to build an "entirely new integration architecture that does not currently exist in iOS" to address the "complex security and privacy concerns associated with web apps using alternative browser engines." This work "was not practical to undertake given the other demands of the DMA and the very low user adoption of Home Screen web apps," Apple explains. "And so, to comply with the DMA's requirements, we had to remove the Home Screen web apps feature in the EU." "EU users will be able to continue accessing websites directly from their Home Screen through a bookmark with minimal impact to their functionality," Apple continues.

It's understandable that Apple wouldn't offer support for Home Screen web apps for third-party browsers. But why did it also remove support for Home Screen web apps for Safari? Unfortunately, that's another side effect of the Digital Markets Act. The DMA requires that all browsers have equality, meaning that Apple can't favor Safari and WebKit over third-party browser engines. Therefore, because it can't offer Home Screen web apps support for third-party browsers, it also can't offer support via Safari. [...] iOS 17.4 is currently available to developers and public beta testers, and is slated for a release in early March.

Apple Pulls Popular Movie Piracy App Kimi From the App Store (wired.com) 25

After climbing the charts of Apple's App Store, the trendy Kimi app, with its collection of bootlegged movies, has disappeared. From a report: Pretending to be a spot-the-difference vision-testing game, the widely downloaded app ranked above Netflix, Hulu, and Amazon Prime Video in Apple's charts this week for free entertainment apps before it was removed. Without having to pay for anything or log in to any kind of account, iPhone owners could previously use Kimi to browse a wide selection of bootlegs for popular movies and TV shows. Many of the movies up for Best Picture at this year's Oscars were on Kimi, at varying levels of quality.

Poor Things was included in a grainy, pixelated state, but a high-quality version of Killers of the Flower Moon was on Kimi to stream, although an intrusive ad for online casinos was splashed across the top. That definitely isn't the viewing experience Martin Scorsese imagined for audiences. Not just limited to movies, viewers were also able to access episodes of currently airing TV shows, like RuPaul's Drag Race, through the Kimi app. Who was behind this piracy app? It remains a mystery. The developer was listed as "Marcus Evans" in the app store before Kimi was taken down, and this was the only app listed under that name, likely a pseudonym.

After Trying the Vision Pro, Mark Zuckerberg Says Quest 3 'is the Better Product, Period' (theverge.com) 109

Now that it can be strapped to our faces and worn to strange places, opinions about Apple's Vision Pro are flying left and right. Entering the chat is Meta CEO Mark Zuckerberg, who has more at stake than perhaps anyone on earth if Apple does to headsets what the iPhone did to smartphones. From a report: In a video posted to his Instagram account on Tuesday, Zuckerberg gives his official verdict on the Vision Pro versus his company's latest Quest 3 headset: "I don't just think that Quest is the better value, I think Quest is the better product, period." While being filmed by the Quest 3's video passthrough system in his living room, Zuckerberg highlights the tradeoffs Apple made to get the fanciest display possible into something that can be worn on your head in an acceptable form factor. He says the Quest 3 weighs 120 grams less, making it more comfortable to wear for longer. He also says it allows for greater motion due to its lack of a wired battery pack and wider field of view than the Vision Pro.

He thinks the Quest's option of physical hand controllers and hand tracking for input is better, though he says he's a fan of eye tracking for some use cases and teases that it will return to future Meta headsets after debuting in the Quest Pro. He says the Quest has a better "immersive" content library than Apple, which is technically true for now, though he admits that the Vision Pro is a better entertainment device. And then there's the fact that the Quest 3 is, as Zuck says, "like seven times less expensive."

Apple's iMessage Avoids EU's Digital Markets Act Regulation (macrumors.com) 39

An anonymous reader quotes a report from MacRumors: Apple's iMessage will avoid regulation requiring interoperability with other messaging platforms under the EU's Digital Markets Act (DMA), following the conclusion of an investigation by the regulator (via Bloomberg). The probe concluded that the iMessage platform and Microsoft's Bing do not hold a dominant enough position to be brought under the DMA's strict rules for services provided by big tech's so-called digital "gatekeepers," which include Apple, Meta, Google, Amazon, and TikTok, according to the EU.

The EU has been working on legislation under the DMA that would have required Apple to make changes to iMessage to make it available on other platforms. The interoperability rules would have meant that Meta apps like WhatsApp or Messenger could request to interoperate with Apple's iMessage framework, and Apple would have been forced to comply within the EU. However, the EU probe found that iMessage falls outside the legislation because it is not widely used by businesses. The reprieve for Apple is part of a five-month market investigation by the European Commission.
It's not all good news for Apple, though. The DMA is still forcing the company to implement updates that will allow iPhone and iPad users to download and install apps outside the App Store through alternative app marketplaces. The changes will arrive with iOS 17.4 in March.

Apple Is Settling Chip Secrets Theft Case Against Startup Rivos, Former Employees (yahoo.com) 5

In 2022 Apple filed a lawsuit against startup Rivos. The lawsuit said that in one year Rivos had hired more than 40 former Apple employees to work on competing system-on-a-chip technology, according to Reuters, "and that at least two former Apple engineers took gigabytes of confidential information with them to Rivos."

But Friday Bloomberg reported that the two companies told a judge that they'd "signed an agreement that potentially settles the case." "The agreement provides for remediation of Apple confidential information based on a forensic examination of Rivos systems and other activities," according to the filing in federal court in San Jose, California. "The parties currently are working through that process."
More details from Engadget: Apple also accused the defendant of instructing the employees it hired away to steal presentations and other proprietary information for unreleased iPhone chip designs that cost billions of dollars to develop. Rivos countersued Apple last year, accusing the larger company of restricting employees' ability to work elsewhere and of hindering emerging startups' growth by using anticompetitive measures.

The court dismissed Apple's trade secret claims against Rivos in April 2023, though the company was allowed to file a revised complaint. Apple already settled with its six former employees who filed a countersuit against the iPhonemaker along with Rivos after they dropped their claims against each other last month.

Both companies are now requesting the court to put their cases on hold until March 15, when they expect the settlement to be completed.

Apple is building prototypes of at least two iPhones that fold widthwise like a clamshell, The Information reported Wednesday. From the report: If Apple ends up launching a foldable iPhone, it would be one of the biggest hardware design changes in the product's history. The foldable iPhones are in early development and aren't on the company's mass production plans for 2024 or 2025, the person said. Apple recently approached at least one manufacturer in Asia for components related to two foldable iPhones of different sizes, they said. The products could be canceled if they don't meet Apple's standards, they said.

Google and Mozilla Don't Like Apple's New iOS Browser Rules 89

Apple is making changes to iOS in Europe to comply with the EU's Digital Markets Act cracking down on Big Tech gatekeepers. The act demands interoperability, fairness and privacy measures including allowing competing browser engines on iOS. Despite better browser choice, Google and Mozilla are unhappy with Apple's proposed changes. Mozilla says restricting browser engine integration to EU apps burdens rivals to build separate implementations. Mozilla's comment: "We are still reviewing the technical details but are extremely disappointed with Apple's proposed plan to restrict the newly-announced BrowserEngineKit to EU-specific apps. The effect of this would be to force an independent browser like Firefox to build and maintain two separate browser implementations -- a burden Apple themselves will not have to bear. Apple's proposals fail to give consumers viable choices by making it as painful as possible for others to provide competitive alternatives to Safari. This is another example of Apple creating barriers to prevent true browser competition on iOS." Google's VP of engineering for Chrome, Parisa Tabriz, commented on DeMonte's statement, saying, "Strong agree with Mozilla. Apple isn't serious about supporting web browser or engine choice on iOS. Their strategy is overly restrictive, and won't meaningfully lead to real choice for browser developers."

Government Hackers Targeted iPhones Owners With Zero-Days, Google Says (techcrunch.com) 11

Government hackers last year exploited three unknown vulnerabilities in Apple's iPhone operating system to target victims with spyware developed by a European startup, according to Google. TechCrunch: On Tuesday, Google's Threat Analysis Group, the company's team that investigates nation-backed hacking, published a report analyzing several government campaigns conducted with hacking tools developed by several spyware and exploit sellers, including Barcelona-based startup Variston. In one of the campaigns, according to Google, government hackers took advantage of three iPhone "zero-days," which are vulnerabilities not known to Apple at the time they were exploited. In this case, the hacking tools were developed by Variston, a surveillance and hacking technology startup whose malware has already been analyzed twice by Google in 2022 and 2023.

Google said it discovered the unknown Variston customer using these zero-days in March 2023 to target iPhones in Indonesia. The hackers delivered an SMS text message containing a malicious link that infected the target's phone with spyware, and then redirected the victim to a news article by the Indonesian newspaper Pikiran Rakyat. Google did not say who was Variston's government customer in this case.

Apple Faces 'Strong Action' If App Store Changes Fall Short, EU's Breton Says (reuters.com) 65

Apple faces strong action if changes to its App Store do not meet incoming European Union regulations, the bloc's industry chief said on Friday. Reuters: In a move designed to comply with the EU's incoming Digital Markets Act (DMA), the company will soon allow software developers to distribute their apps to Apple devices via alternative stores. From early March, developers will be able to offer alternative app stores on iPhones and opt out of using Apple's in-app payment system, which charges commissions of up to 30%.

However, critics have said the changes do not go far enough, arguing Apple's fee structure remains unfair, and that the changes may be in violation of the DMA. Asked about Apple's plans, EU industry chief Thierry Breton exclusively told Reuters: "The DMA will open the gates of the internet to competition so that digital markets are fair and open. Change is already happening. As from 7 March we will assess companies' proposals, with the feedback of third parties." He added: "If the proposed solutions are not good enough, we will not hesitate to take strong action."

Shameless Insult, Malicious Compliance, Junk Fees, Extortion Regime: Industry Reacts To Apple's Proposed Changes Over Digital Markets Act 255

In response to new EU regulations, Apple on Thursday outlined plans to allow iOS developers to distribute apps outside the App Store starting in March, though developers must still submit apps for Apple's review and pay commissions. Now critics say the changes don't go far enough and Apple retains too much control.

Epic Games CEO Tim Sweeney: They are forcing developers to choose between App Store exclusivity and the store terms, which will be illegal under DMA (Digital Markets Act), or accept a new also-illegal anticompetitive scheme rife with new Junk Fees on downloads and new Apple taxes on payments they don't process. 37signals's David Heinemeier Hansson, who is also the creator of Ruby on Rails: Let's start with the extortion regime that'll befell any large developer who might be tempted to try hosting their app in one of these new alternative app stores that the EU forced Apple to allow. And let's take Meta as a good example. Their Instagram app alone is used by over 300 million people in Europe. Let's just say for easy math there's 250 million of those in the EU. In order to distribute Instagram on, say, a new Microsoft iOS App Store, Meta would have to pay Apple $11,277,174 PER MONTH(!!!) as a "Core Technology Fee." That's $135 MILLION DOLLARS per year. Just for the privilege of putting Instagram into a competing store. No fee if they stay in Apple's App Store exclusively.

Holy shakedown, batman! That might be the most blatant extortion attempt ever committed to public policy by any technology company ever. And Meta has many successful apps! WhatsApp is even more popular in Europe than Instagram, so that's another $135M+/year. Then they gotta pay for the Facebook app too. There's the Messenger app. You add a hundred million here and a hundred million there, and suddenly you're talking about real money! Even for a big corporation like Meta, it would be an insane expense to offer all their apps in these new alternative app stores.

Which, of course, is the entire point. Apple doesn't want Meta, or anyone, to actually use these alternative app stores. They want everything to stay exactly as it is, so they can continue with the rake undisturbed. This poison pill is therefore explicitly designed to ensure that no second-party app store ever takes off. Without any of the big apps, there will be no draw, and there'll be no stores. All of the EU's efforts to create competition in the digital markets will be for nothing. And Apple gets to send a clear signal: If you interrupt our tool-booth operation, we'll make you regret it, and we'll make you pay. Don't resist, just let it be. Let's hope the EU doesn't just let it be.
Coalition of App Fairness, an industry body that represents over 70 firms including Tinder, Spotify, Proton, Tile, and News Media Europe: "Apple clearly has no intention to comply with the DMA. Apple is introducing new fees on direct downloads and payments they do nothing to process, which violates the law. This plan does not achieve the DMA's goal to increase competition and fairness in the digital market -- it is not fair, reasonable, nor non-discriminatory," said Rick VanMeter, Executive Director of the Coalition for App Fairness.

"Apple's proposal forces developers to choose between two anticompetitive and illegal options. Either stick with the terrible status quo or opt into a new convoluted set of terms that are bad for developers and consumers alike. This is yet another attempt to circumvent regulation, the likes of which we've seen in the United States, the Netherlands and South Korea. Apple's 'plan' is a shameless insult to the European Commission and the millions of European consumers they represent -- it must not stand and should be rejected by the Commission."

Apple is Bringing Sideloading and Alternate App Stores To the iPhone (theverge.com) 104

The iPhone's app ecosystem is about to go through its biggest shake-up since the App Store launched in 2008. Today, Apple announced how it plans to change the rules for developers releasing iOS software in the European Union in response to the bloc's Digital Markets Act (DMA) coming into force in March. The big news is that third-party app stores will be allowed on iOS for the first time, breaking the Apple App Store's position as the sole distributor of iPhone apps. The changes will arrive with iOS 17.4 in March. From a report: Here's how the new "alternative app marketplaces," as Apple called them, will work. Users in the EU and on iOS 17.4 will be able to download a marketplace from that marketplace's website. In order to be used on an iPhone, those marketplaces have to go through Apple's approval process, and once you download one, you have to explicitly give it permission to download apps to your device. But once the marketplace is approved and on your device, you can download anything you want -- including apps that violate App Store guidelines. You can even set a non-App Store marketplace as the default on your device.

Developers, meanwhile, can choose whether to use Apple's payment services and in-app purchases or integrate a third-party system for payments without paying an additional fee to Apple. If the developer wants to stick with Apple's existing in-app payment system, there's an additional 3 percent processing fee. Apple still plans to keep a close eye on the app distribution process. All apps must be "notarized" by Apple, and distribution through third-party marketplaces is still managed by Apple's systems. Developers will only be allowed to distribute a single version of their app across different app stores, and they'll still have to abide by some basic platform requirements, like getting scanned for malware.
Apple says that anyone looking to develop an alternative app marketplace will have to provide evidence that it can financially "guarantee support for developers and customers." Apple wants "a stand-by letter of credit from an A-rated (or equivalent by S&P, Fitch, or Moody's) financial Institution of 1 million Euro prior to receiving the entitlement. It will need to be auto-renewed on a yearly basis."

The Mac Turns 40 (theverge.com) 135

Apple's longest-running product is an increasingly small part of the company's business. And yet, it's never been more successful. Jason Snell, writing for The Verge: Twenty years ago, on the Mac's 20th anniversary, I asked Steve Jobs if the Mac would still be relevant to Apple in the age of the iPod. He scoffed at the prospect of the Mac not being important: "of course" it would be. Yet, 10 years later, Apple's revenue was increasingly dominated by the iPhone, and the recent success of the new iPad had provided another banner product for the company. When I interviewed Apple exec Phil Schiller for the Mac's 30th anniversary, I found myself asking him about the Mac's relevance, too. He also scoffed: "Our view is, the Mac keeps going forever," he said.

Today marks 40 years since Jobs unveiled the original Macintosh at an event in Cupertino, and it once again feels right to ask what's next for the Mac. Next week, Apple will release financial results that will reinforce that Mac sales are among the best they've been in the product's history. Then, a day later, Apple will release a new device, the Vision Pro, that will join the iPhone, iPad, and Apple Watch in an ever-expanding lineup of which the Mac is only one small part. As the Mac turns 40, it's never been more successful -- or more irrelevant to Apple's bottom line. It's undergone massive changes in the past few years that ensure its survival but also lash it to a hardware design process dominated by the iPhone. Being middle-aged can be complicated.

Mac users -- and I've been one of them for 34 of those 40 years -- have been on the defensive for most of the platform's existence. The original Mac cost $2,495 (equivalent to more than $7,300 today), and it had to compete with Apple's own Apple II series, which was more affordable and wildly successful. The Mac was far from a sure thing, even at Apple: in the years after the Mac was first introduced, Apple released multiple new Apple II models. (One even had a mouse and ran a version of the Mac's Finder file manager.) It took a long time for the Mac to emerge from the Apple II's shadow. And as revolutionary as the Mac's interface was -- it was the first popular personal computer to have a mouse-driven, menu-oriented user interface rather than a simple command line -- it also had to overcome an enormous amount of resistance for being such an outlier. Once Microsoft truly embraced the Mac's interface style with Windows, it took over the world, leaving the Mac with measly market share and diminishing prospects.

Apple Plans New Fees and Restrictions for Downloads Outside App Store (wsj.com) 140

Users will be able to download apps outside the App Store for the first time, but Apple will review each app, collect fees from developers, and add other limits, WSJ reported Wednesday. The policies will apply only in Europe and test enforcement of the law. Spotify, Meta, Microsoft and others are preparing new direct download options in anticipation. Apple has defended controlling downloads via the App Store as necessary for iPhone security and quality, but critics call it anticompetitive and say Apple collects unfairly high commissions. Apple Might Have Sold Up To 180,000 Vision Pro Headsets Over Pre-Order Weekend (engadget.com) 108

According to analyst Min-Chi Kuo, Apple may have sold somewhere between 160,000 to 180,000 Vision Pro headsets during the past weekend. "This already far exceeds Kuo's earlier production figures of 60,000 to 80,000 units targeting the initial release on February 2, which is no wonder that the Vision Pro was sold out immediately after pre-orders opened," notes Engadget. From the report: While this sounds like positive news, Kuo pointed out that with shipping times remaining unchanged within the first 48 hours, this might indicate a quick drop in demand after the heavy users and hardcore fans were done pre-ordering. In contrast, iPhone orders would usually "see a steady increase in shipping times 24 to 48 hours after pre-orders open." But of course, the Vision Pro isn't meant for the average consumer in its current state, especially given the lack of some mainstream apps like YouTube, Spotify or Netflix. Not to mention the eye-watering $3,499 base price either, though Apple may later release a cheaper model in the ballpark of $1,500 to $2,500, according to an earlier report by Bloomberg's Mark Gurman.

Kuo added that even with the device being sold out based on the upper initial production figure of 80,000 units, that only accounts for about 0.007 percent of Apple's 1.2 billion active users, which makes the Vision Pro "a very niche product" in the eyes of Cupertino. That is to say, the tech giant will need to somehow drum up and sustain demand for the headset before its global launch, which is rumored to take place some time before this year's WWDC -- likely in June. Meanwhile, Apple is also busy setting up demo areas at its US flagship stores, in the hopes of making a few more sales with their 25-minute sessions.

Microsoft's Bing Market Share Barely Budged With ChatGPT Add-On (bloomberg.com) 48

When Microsoft announced it was baking ChatGPT into its Bing search engine last February, bullish analysts declared the move an "iPhone moment" that could upend the search market and chip away at Google's dominance. "The entire search category is now going through a sea change," Chief Executive Officer Satya Nadella said at the time. "That opportunity comes very few times." Almost a year later, the sea has yet to change. Bloomberg: The new Bing -- powered by OpenAI's generative AI technology -- dazzled internet users with conversational replies to queries asked in a natural way. But Microsoft's search engine ended 2023 with just 3.4% of the global search market, according to data analytics firm StatCounter, up less than 1 percentage point since the ChatGPT announcement.

Bing has long struggled for relevance and attracted more mockery than recognition over the years as a serious alternative to Google. Multiple rebrandings and redesigns since its 2009 debut did little to boost Bing's popularity. A month before Microsoft infused the search engine with generative AI, people were spending 33% less time using it than they had 12 months earlier, according to SensorTower. The ChatGPT reboot at least helped reverse those declines. In the second quarter of 2023, US monthly active users more than doubled year over year to 3.1 million, according to a Bloomberg Intelligence analysis of SensorTower mobile app data. Overall, users were spending 84% more time on the search engine, the data show. By year-end, Bing's monthly active users had increased steadily to 4.4 million, according to SensorTower.

Apple Tops Samsung For First Time in Global Smartphone Shipments (theverge.com) 18

For the first time ever, Apple beat out Samsung to ship the most smartphones in a year according to IDC's Worldwide Quarterly Mobile Phone Tracker. From a report: Although IDC cautions that its data is preliminary and subject to change, a second research agency, Canalys, also has Apple taking its top spot for all of 2023. IDC has Apple's total mobile shipments at 234.6 million, versus 226.6 million for Samsung. Xiaomi, Oppo, and Transsion round out the top five with 145.9, 103.1 and 94.9 million smartphones shipped, respectively.

IDC notes that the last time Samsung wasn't on top of the annual board was 13 years ago in 2010. Back then Apple didn't even feature in the top five. Instead it was Nokia in first place, Samsung in second, LG Electronics in third, ZTE in fourth, and Research in Motion (manufacturers of BlackBerry devices) in fifth.

Supreme Court Rejects Apple-Epic Games Legal Battle (reuters.com) 52

The U.S. Supreme Court on Tuesday declined to hear a challenge by Apple to a lower court's decision requiring changes to certain rules in its lucrative App Store, as the justices shunned the lengthy legal battle between the iPhone maker and Epic Games, maker of the popular video game "Fortnite." Reuters: The justices also turned away Epic's appeal of the lower court's ruling that Apple's App Store policies limiting how software is distributed and paid for do not violate federal antitrust laws. The justices gave no reasons for their decision to deny the appeals. In a series of posts on X, Epic CEO Tim Sweeney wrote: The Supreme Court denied both sides' appeals of the Epic v. Apple antitrust case. The court battle to open iOS to competing stores and payments is lost in the United States. A sad outcome for all developers. Now the District Court's injunction against Apple's anti-steering rule is in effect, and developers can include in their apps "buttons, external links, or other calls to action that direct customers to purchasing mechanisms, in addition to IAP."

As of today, developers can begin exercising their court-established right to tell US customers about better prices on the web. These awful Apple-mandated confusion screens are over and done forever. The fight goes on. Regulators are taking action and policymakers around the world are passing new laws to end Apple's illegal and anticompetitive app store practices. The European Union's Digital Markets Act goes into effect March 7.

Apple To Remove Blood-Oxygen Tool To Avoid Ban, Masimo Says (bloomberg.com) 38

Apple is removing a blood-oxygen feature from its latest smartwatches -- the Series 9 and Ultra 2 -- to get around a US ban stemming from a patent dispute with Masimo. From a report: The disclosure was made Monday by Masimo, which said that US Customs and Border Protection approved the change on Jan. 12. The agency "decided that Apple's redesign falls outside the scope" of an import ban by the US International Trade Commission, signaling that the adjustment will let Apple keep its watches on the market.

The ITC had ruled in October that Apple's devices violated Masimo patents related to blood-oxygen measurement. That led Apple to pause sales of the smartwatches just ahead of Christmas, though an interim stay allowed the company to bring the products back late last month. The iPhone maker developed a software workaround intended to sidestep the dispute and presented the solution last week to the customs agency, which is in charge of enforcing import bans. Apple explained that the redesigned watches "definitively" do not contain the technology at issue, known as pulse oximetry, according to Masimo.

From a report: In the latest edition of his "Power On" newsletter, Gurman explained that Apple is gearing up to make changes to the App Store in the EU to comply with the region's impending Digital Markets Act (DMA). Apple is apparently planning to roll out adjustments to comply with the new legal requirements in the coming weeks, including splitting off the App Store in the EU from the rest of the world. The deadline for Apple to comply with the DMA is March 7, so the company has just over seven weeks to enact the changes.
